Cela me demande
beaucoup de courage et d'humilité pour raconter ce que j'ai vécu durant ces
dernières années. Plusieurs me connaissent en tant qu’arbitre de soccer dans
les régions de Québec et des Laurentides. L'arbitre a laissé sa place à l'être
humain. Pourquoi? Laissez-moi vous raconter...
Avant de
débuter, établissons le contexte. En 2012, j'étais un arbitre de grade
provincial (anciennement appelé niveau 1), un instructeur et un évaluateur
provincial d'arbitres et je travaillais comme coordonnateur de l'arbitrage pour
l'Association Régionale de Soccer (ARS) des Laurentides. J'officiais
régulièrement des matchs de niveau AAA (particulièrement du senior),
semi-professionnel et scolaire (matchs universitaires et finales collégiales
AAA). À ce niveau, les matchs nous sont assignés par la Fédération de soccer du
Québec (FSQ) via l'assignateur provincial. Tout allait bien jusqu'en octobre
2012. C’est alors que je reçois un appel téléphonique me
faisant part d'une éventuelle plainte à mon égard : on me dit que je
pourrais être convoqué en comité de discipline provincial et être suspendu à
vie. Tout a basculé. Cette plainte à mon égard faisait mention que je me serais
avantagé personnellement, professionnellement et financièrement en modifiant
des assignations d’arbitres dans le système PTS-REF. Ce dernier est une
plate-forme que les arbitres et dirigeants d’arbitrage utilisent pour consulter
ou pour faire des assignations d’arbitre sur des matchs. À ce moment, je
commence à réfléchir à la suite imminente des choses en engageant des
procédures-conseils auprès d'un avocat.
Je reçois donc, le 7 novembre 2012, une
convocation pour me présenter devant le comité de discipline provincial de la
FSQ puisqu'une plainte a été déposée contre moi. Cette dernière est signée par
M. Bertrand Gallot et M. Lyes Arfa, respectivement coordonnateur et directeur
de l’arbitrage de la FSQ à l’époque. On m'accuse selon l'article 33.2 du
règlement de discipline, soit :
Toute personne qui porte préjudice au soccer, qui utilise son poste
pour fins personnelles ou qui démontre une négligence flagrante dans
l'application des statuts et règlements de la Fédération, d'une ARS ou d'une
ligue AAA / AA est traduite devant le comité de discipline qui a juridiction en
l'espèce et peut recevoir une suspension à vie au maximum.

Je fais part de
cette convocation à mon avocat et ce dernier me signale que ce type
d'accusation s'apparente à une fraude et/ou du vol. De plus, la convocation
était prévue pour le 16 novembre, ce qui ne me laissait guère le temps de
préparer une défense pleine et entière. J'ai envoyé à plusieurs reprises des
lettres (par l'entremise de mon avocat) à la FSQ afin de faire valoir mes
droits. Celles-ci étaient datées respectivement des 8, 12 et 19 novembre 2012.
Dans ces communications, mon procureur a soulevé plusieurs irrégularités méritant
d'être examinées, à savoir :
- l'article 33.2 était inapplicable dans les circonstances;
- l'incompréhension et le manque de clarté de l'avis de convocation;
- la date rapprochée de l'audition (convoqué le 7 novembre pour le 16 novembre);
- aucune tentative n'a été prise par la FSQ afin de me permettre d'expliquer ma version des faits;
- plusieurs journées d'audition seront nécessaires considérant le droit complexe impliqué;
- la preuve et la liste des témoins nous étaient inconnues.
Suite aux
lettres de mon avocat, nous avons réussi à faire déplacer la date de l'audition
du 16 novembre 2012 au 29 novembre 2012. Cette première rencontre a été
surprenante pour le moins. En effet, mon avocat est avisé qu'une telle cause ne
peut être tenue en une seule séance (ce que nous avions déjà mentionné dans nos
lettres). Nous apprenons que l'avocat de la FSQ, Me LeGros, siège au
comité en guise d'aide. Nous avons demandé qu'il se récuse, mais notre demande
fut rejetée. Nous sommes avisés sur le champ et sans préavis qu'il n'y aurait
aucune possibilité de contre-interroger les témoins, ce qui va à l'encontre
du droit naturel (étrange de constater que le comité de discipline
provincial de la FSQ siégeant à l'ARS Québec autorise le
contre-interrogatoire). Bref, cette première rencontre a servi à établir la
preuve de la partie plaignante, soit la FSQ. Plusieurs arbitres et anciens amis
personnels, dont je tairai les noms, sont venus témoigner contre moi, à ma
grande surprise. Aussi, une personne de confiance m'a souligné qu'elle avait
été rencontrée pour corroborer certains propos et faits qu’elle-même n'avait
pas entendus.
La seconde
rencontre, le 4 décembre 2012, nous avons déposé notre preuve. Cette dernière
contenait une lettre certifiée des caisses Desjardins datée de mai 2012 attestant que mon ordinateur portable de bureau de
l'ARS Laurentides avait été infiltré et que tous mes comptes bancaires avaient
dû être gelés. De plus, nous avons démontré certaines failles à l’intérieur du
système PTS-REF que d’autres régions du Québec avaient aussi vécues. Certains de mes témoins sont venus
corroborer ces faits. Nous avons terminé notre preuve en interrogeant nos trois
témoins. L'un d'eux, expert en informatique, a démontré que mon portable avait
toujours des logiciels virulents au moment de l'audition. Également, il a été
soulevé que certaines modifications d'assignations ont eu lieu alors que je me
trouvais en Europe pour mes vacances.
La troisième
séance a eu lieu le 12 janvier 2013. Cette dernière a permis aux deux parties
de faire leurs plaidoyers. Deux jours plus tard, soit le 14 janvier 2013, nous
recevons un avis du comité de discipline mentionnant que la plainte a été
rejetée à l'unanimité et que la décision détaillée nous sera communiquée.
Le 5 février
2013, nous recevons le jugement du comité de discipline provincial de la FSQ.
Il est mentionné dans ce dernier que l'article utilisé ne s'appliquait pas à
la cause (ce qui avait été soulevé à de nombreuses reprises par mon avocat)
et que le comité tenait « toutefois à ajouter que la preuve soumise
par la Fédération n'a pas démontré un lien entre les transactions PTS et
monsieur Arcand-Langlois » (citation originale). Bref, une victoire pour moi et ce, dans leur propre comité
de discipline!
Le 4 mars 2013,
mon avocat fait parvenir une lettre par courrier recommandé au président de la
FSQ, M. Martial Prud'homme, à son bureau personnel. Le but de cette
communication était de faire part de mes demandes suite à la décision du comité
de discipline. Une de mes demandes était de rencontrer personnellement M.
Prud'homme afin de discuter de tous sujets
utiles à la résolution de ce conflit. Nous avions déterminé une date
limite (25 mars 2013) pour obtenir une réponse de la part de M. Prud'homme.
Nous n'avons reçu aucun signe de vie de sa part. Considérant que mes demandes
méritaient d'être entendues, j'ai décidé, conjointement avec mon avocat, de
poursuivre afin d'obtenir réparation. Tout ce processus se déroula entre avril
2013 et décembre 2013.
Plusieurs
communications ont eu lieu entre mon avocat et l'avocate des assurances de la
FSQ. Cette dernière demande alors de porter la cause en médiation (janvier
2014). En mai 2014, je suis convoqué à une séance conjointe de règlement à
l'amiable au Palais de justice de Laval. Cette rencontre fut d'une durée
approximative de sept (7) heures et suite à cette journée, une entente hors
cour est intervenue.
Jusqu'à
maintenant, je n'ai présenté que des faits vérifiables (documents
à l’appui) et d'ordre public. Cependant,
je tiens à ajouter que j'ai subi de nombreuses séquelles tout au long de ce
processus. J'ai d'abord eu à démissionner de mon poste de coordonnateur à
l'arbitrage (mai 2013). Vous comprendrez qu'il est difficile de travailler en
étroite collaboration avec des gens qui ont porté des
accusations contre moi. De plus, j'ai déménagé dans la région de Québec en
juin 2013 suite à ma démission. Mon médecin m'a aussi mis en arrêt de travail avec des suivis psychologiques et médicaux pendant plus de neuf
(9) mois. En ce qui concerne ma carrière d'arbitrage, mon rêve
d'arbitrer des matchs de plus haut niveau a été complètement anéanti de même
que ma réputation sportive. J'ai d'ailleurs été refusé au programme « Top
10 » de la FSQ (ce programme sert de porte d'entrée pour la liste
nationale des arbitres de l'Association canadienne de soccer) puisque le comité
de sélection n'a pas été convaincu de l'excellence de ma candidature. Avec toute mon expérience, plus de 100 matchs senior
AAA et universitaires à titre d'arbitre de centre, mes trois (3) recommandations (2009 à 2011) par le
Comité Provincial d'Arbitrage de la FSQ pour faire partie du programme de
nomination nationale, mes neuf (9) championnats canadiens et mes trois (3)
lettres de recommandation par des évaluateurs nationaux, vous me
permettrez de douter du sérieux d'une telle décision prise suite à ces
événements. Finalement, j'ai été supris d'apprendre en 2015, malgré mon billet
médical, mon retrait de la liste provinciale des arbitres par le directeur de
l'arbitrage de l'ARS Québec, et ce, malgré mes demandes répétées pour obtenir
le règlement écrit justifiant une telle décision.
Le but de ce
texte était de rendre publique mon histoire. Cet écrit permettra de faire taire les différentes
rumeurs qui courent toujours au sujet de ce dossier. Également, l'un des buts
de ce texte est de faire la lumière sur les différentes problématiques
administratives qui existent au Québec en ce qui concerne le soccer. L'une
d'entre elles concerne l'assurance juridique. Étant employé à l'ARS
Laurentides, j'ai appris lors de ce processus que la police d'assurance de Sport-Québec couvrant
les frais juridiques était la même que celle de la FSQ. Ainsi, j'ai dû débourser
plus de 50 000 $ afin d'établir ma défense, et ce, sans aucune assurance.
Il est évident que d'autres arbitres, employés, entraineurs ou organisations ont vécu diverses injustices tout comme moi. Une question alors se pose : Comment le Ministère de
l’Éducation, des Loisirs et du Sport du Québec (MELS) ainsi que Sport-Québec
laissent opérer un organisme en dépensant les fonds publics de cette manière? Il est peut-être temps qu'un vent de changement
s'impose au Québec en ce qui concerne le respect et le regroupement des droits
des arbitres, employés, entraineurs ou
organisations dans le milieu du soccer.
J’aimerais
remercier ma famille et mes amis qui, à présent, tente de panser leurs plaies et nous croyons que ce texte est la première étape
d'un long processus. Mon histoire se veut le commencement d'un mouvement et
j'espère vivement que d'autres personnes courageuses et impliquées dans le
monde du soccer oseront, comme moi, raconter leur histoire. Il est probable que
je ne sois pas le seul...

Wrongfully accused in 2012 and then
cleared of all charges by the disciplinary comity of the provincial soccer
federation of Quebec, I will attempt now to tell the full story. It is important that the facts that have cost
me almost 50 000$ in legal fees and my dream of having a career as a referee be
known to the public.

It has taken me a lot of courage and

these last few years. A lot of you have
known me through my refereeing through the regions of Quebec and the
Laurentides. For now, the referee in me
has been superseded by the human being in me .
Why you ask? Let me tell you about it...
Before I start, lets establish the context behind this story. In 2012, I was a provincial grade referee (formerly known as grade 1), an instructor and an evaluator of provincial referees and I was also working as the coordinator for refereeing in the Soccer Regional Association (SRA) of the Laurentides. I was refereeing on a regular basis various matches of the AAA caliber (mostly senior), semi-professional and academic (university grade and collegial finals of the AAA category) varieties as well . At this level it was the provincial assignor that would decide which matches we would have to referee. All was well up until October of 2012. It is at about that time that I have receive a call informing me that I could be suspended for life by the provincial disciplinary comity because of a complaint. At this point things took a turn for the worse. The complaint basically was accusing me of toying around with the PTS-REF system to give myself a personal, professional and financial advantage by modifying the refereeing assignments in the system. The PTS-REF system is a platform used by referees and arbitration officials to consult and assign referees to various matches. Following this I then decide to hire the services of an attorney as a precautionary measure to protect myself.

On the 7th of November 2012, I then receive an
invitation to appear in front of the provincial disciplinary comity of the QSF
because of the complaint mentioned above.
I then discover that the complaint has been formulated by Bertrand
Gallot and Lyes Arfa both of them being respectively the coordinator and the director
of the refereeing of the QSF at that time.
I am then accused according to article 33.2 of the disciplinary
regulation, being the following ;
Anyone who harms soccer,
using his position for personal benefit or that demonstrates gross negligence
in the implementation of the Federation bylaws, of an LRA or an AAA / AA league
is brought before the committee discipline which has jurisdiction in this case
and can receive a maximum suspension for life.

I then sought the counsel of my attorney on what to do next, he then proceeded to inform me that these accusations are akin to being charged with fraud or theft. As well, the convocation being held on the 16th of November, it was very hard for me to prepare an adequate defense strategy with my legal counsel. I have then proceeded to send multiple letters through my attorney to the QSF requesting that they be diligent and enable me to exercise my rights in a proper matter and give me the proper allotted time to prepare for such a convocation. These letters are dated respectively from the 8th, 12th and 19th of November 2012. In these communications with the QSF, my attorney has noticed irregularities that he has deemed worth investigating. Those irregularities are the following;
1) Article 33.2
was inapplicable in these particular circumstances2) The convocation was both incomprehensible and lacked clarity3) The imminent date of the convocation (received on
the 7th for the 16th of November)4)The fact that in no time the QSF has attempted to
contact me to get my version of the facts5) the names of the witnesses and the nature of the
evidence were not communicated to either my attorney or myself during this
whole ordeal
Following the flurry of communications that I have mentioned above, my
legal counsel and I have succeeded in moving the hearing from the 16th to the
29th of November 2012. At this first
hearing my attorney is then informed that such a complaint cannot be dealt with
in a single hearing (it has been something we have pointed out to the comity
beforehand in one of our communications).
We then learn that the attorney tasked to defend the QSF's position (Me
LeGros) is also a counselor on that said comity. Following this announcement, we then ask that
he may not be part of the proceedings, in which case, our demand is then again
rejected. Furthermore, we are also
informed that there will be no possibility for us to counter-interrogate the
witnesses, which directly contravenes the natural right of law (it is strange
to note that the provincial comity of discipline of the QSF at the SRA Quebec authorises the
use of the counter interrogation). At
the first hearing the prosecution was allowed to establish the QSF version of
the facts. Many referees and personal
acquaintances' have also, to my great surprised, been invited to bear witness
against me at that particular hearing. A
trusted acquaintance of mine has also been approached by the QSF to confirm
certain rumors that have been circulating concerning the complaint lodged
against me.
On the 2nd hearing, which was held on the 4th of
December 2012, we were finally able to expose the evidence in our
possession. Our evidence consisted of a
certified letter from the caisses Desjardins dated from May 2012 confirming
that my laptop computer at the office of the ARS Laurentides was hacked into
and that all my bank accounts were essentially frozen for the time being.
We have then proceeded to demonstrate the multiple failing of the
PTS-REF system that have also been experienced by the other regions comprising
the QSF. A few of the witnesses called
forth by our defense have testified to confirm these failings. One of our witnesses, a computer expert, has
also testified to the fact that my laptop was still infected by various
malicious software even at the later dates of the hearings. Also it has been pointed out to the
prosecution that certain modification of refereeing assignment have been done
while I was on vacation in Europe.
The 3rd hearing was held on the 12th of January
2013. This ultimate hearing was held so
that both parties could express their closing arguments. Two days later on the 14th of January, we
then receive a notice from the disciplinary comity completely exonerating us me
from all charges (it was done unanimously by the comity) and that a more
detailed decision would be forwarded to us later on.
On the 5th of February 2013 we finally receive the ultimate judgment of
the provincial disciplinary comity of the QSF.
In this particular note, it is mentioned that the article used in the
initial indictment should not have been used at all (which has been pointed out
on multiple occasion by my attorney).
Also this communication has admitted to the fact the that comity was not
able to establish any links between the PTS transactions and Mister
Arcand-Langlois. Finally I was satisfied
with the victory because it was that same comity that was trying to indict me
ended up exonerating me at last.
On the 4th of March 2013 my attorney has forwarded by registered mail a
letter, to the president of the QSF, Martial Prud'homme, at his personal
office. The goal of this communication,
was to express my requests to M. Prud'homme following the decision enounced by
the comity of discipline. One of my
demands was to personally meet with M. Prud'homme in order to discuss the many
subjects that would completely resolve the legal conflict that opposed his
organisation to myself. M. Prud'homme
did not respond within a timely fashion to my request (we have waited up until
March the 25th 2013 for a response by him but we received none). Considering that my demands were reasonable
and were deemed worthy of being heard, we have decided then to pursue for
reparations. All of the following has
happened between April 2013 and December
2013.
More communications then followed between my legal
counsel and the attorney of the insurance of the QSF. Their attorney finally appealed to bring the
case for mediation (January 2014). In
May 2014, I then received a convocation for an out of court settlement plea at
the Palais de justice de Laval, this meeting lasted approximately 7 hours.
Following these seven hours an out of court settlement was then agreed upon by
both parties.
Up until now I have always verifiable facts (with
documents to support these). I have to
add that I have suffered enormous collateral damage throughout this whole
affair. I have first and foremost had to
quit as the refereeing coordinator (May 2013).
It would be easy for you to understand that I was unable to work in
collaboration with the same people who have wrongfully accused me of this most
heinous crime. I have also had to move
to the vicinity of the city of Quebec in the month of June 2013 following my resignation. I have had to be stopped by my doctor for a
period of almost 9 months , on medical leave with all the woes that accompany
this forced break time (i.e.
psychological and medical follow ups regularly). But of foremost importance to me, my dream
career as a referee in the higher up leagues of the game was completely
destroyed and my professional reputation forever tarnished by these
proceedings. My request to be part of
the program called the "Top 10" has also been refused (this program
is usually a way into the national
referee association of Canadian soccer) due to the above mentioned
proceedings. With all my experience,
i.e. more than a 100 games at the senior AAA and university level of the game
as a center referee, 3 recommendations (from 2009 to 2011) by the Arbitration
Provincial Comity of the QSF to be part of the national nomination program, my
participation in 9 Canadian competitive championships, and my 3 letters of
recommendations that were written up by the national evaluators, permit me to
be dubious as to why I was not able to proceed forward with my career
plans following these legal
proceedings. Finally, I was appalled to
learn in 2015 that notwithstanding my medical leave bill I was pulled from the
provincial list of referees by the director of the refereeing of SRA Quebec and
this despite my repeated requests to obtain the written regulation that would
justify such a decision.
The goal of this letter is to publicly tell my story. This letter will as well quell any rumors that
are still circulating concerning this whole situation. The other objective is also bring to
light all the various administrative
issues that plague soccer in the province of Quebec. One of these issues would pertain to the
legal assistance aspect of this situation.
Being an employee of the SRA Laurentides, I have learned that the
insurance policy of Sport-Quebec offers the same legal assistance to the QSF,
hence I had to pay almost 50,000$ out of my own pockets without any type of
insurance. It is most evident that I am
not the only one who had to endure such a situation (i.e. employees, other
referees, trainers, etc.), knowing this how can the Ministère de l'Éducation,
des Loisirs et du Sport du Québec (MELS) and Sport-Québec stand idly by and let
a publicly funded organism act in this fashion? It may by the time for change
when it comes to the respect that should be alloted to the rights of referees,
trainers and organisers of the soccer field in the province of Quebec.
I would like to thank all my family and friends that
are helping heal from this whole ordeal, we think that this letter is the
beginning of a long process that will hopefully enact change in the sport. This story should be a starting point, and I
hope that others will be courageous enough to come forward and share their
harrowing tales in order to inact the change that is needed in the world of
soccer today. It is very probable that I
am not the only one...
